REPORT: Man driving erratically jailed on drug, DUI charges

Polk County Police arrested an Aragon man on Wednesday night after he was followed by officers from Wolfe’s Grocery all the way to West First Street before he was stopped and ultimately found with drugs, according to reports.

Officers were following behind Benny Leroy Duncan, 66, of an Aragon address on Wednesday night just after 10 p.m. when he left the Wolfe’s Grocery on New Prospect Road.

He was driving without a functional brake light, and police began to follow him and watched as he swerved over the fog line and into the opposite lane of travel on a turn onto West First Street.

Police ultimately stopped him on West First Street, and when they got a look inside the car they asked Duncan out immediately. The officer was concerned since what appeared to be a rifle was in the car, along with other potential blunt force weapons like a hammer.

Duncan was also fidgeting with his pockets which also concerned officers and asked him to keep his hands where they could see them. Police got him to the back of the truck and began to pat him down for weapons, and Duncan kept sticking his hands in his pocket trying to conceal something hidden.

Concerned for their safety, police ordered Duncan several times to keep his hands free. He ultimately found himself being tackled by officers in the back of his pickup truck and a bag of methamphetamine was discovered. He gave in, was handcuffed, and taken into custody without further incident.

When police searched the truck after he was in custody, they found a pellet rifle instead of an actual firearm, a half of a bottle of Eagle Rare Kentucky bourbon. No other contraband was found on him or in the vehicle.

Duncan remained in custody on a felony charge of possession of methamphetamine, and misdemeanor charges of open container violation, obstruction law enforcement officers, no brake lights or working turn signals, driving on wrong side of roadway, failure to maintain lane and driving under the influence.

His bond was denied.
