POLICE: Officer caught man in the act in domestic incident

A man was caught in the act on Sunday by an officer who entered a home after hearing the sounds of an altercation on Fairview Road, according to a Polk County Police report.

PCPD arrested Richard Lewis Turner, 49, of a Rockmart address, on multiple charges after officers were called out on Sunday evening, June 30, to the Fairview Road address to a report of domestic violence underway.

When the reporting officer arrived, they first found a witness who expressed serious concern about Turner’s behavior and then the officer heard additional commotion coming from within the residence. When he got up to the porch, the sounds of glass breaking and someone being struck and the screams of “stop hitting me” compelled him to take immediate action.

The officer entered the home and reported finding Turner “over the top” of the victim who was crying and seated on a chair. Turner was taken into custody and onward to the porch so each person could be questioned.

Police on the scene noted that Turner appeared to be heavily intoxicated during the incident, and could not provide any statement about what happened that made sense.

The victim provided police with audio evidence of what started the argument and the assault, along with a recording of the assault occurring.

Police also got information from another witness who called 911 that Turner attempted to get them to hang up the phone during the altercation.

Turner was taken onward to the Polk County Jail without incident on misdemeanor charges of obstructing or hindering persons making emergency telephone call, simple battery, battery under the family violence act and cruelty to children in the third degree.

He remained in custody without bond set as of this posting.
