A man previously charged on accusations he had inappropriate contact with a minor was found to be not guilty in a trial earlier this month on Floyd County Superior Court.

Josh Colton Acrey was charged in 2024 with several felony counts against him after accusations were made that he had inappropriate contact with his three year old son, but after a four-day trial in court in Rome, he was found not guilty by a jury of his peers.

In a press release from his attorneys at Gammon, McFall and Villarreal put out earlier this month following the conclusion of the trial on Jan. 15, they noted that “the court granted a Directed Verdict of Acquittal” on one of the charges after the state failed to “provide adequate evidence to support” the charge.

Brad McFall, the attorney of record on the case, noted as well in the release that “the jury only deliberated for 58 minutes before they returned with a not guilty verdict as to all charges.”

“According to McFall, it became clear during the trial that the allegations brought against Mr. Acrey were false and the child had been coached by his mother to make those allegations,” the release stated. “Additionally, it was also revealed that Mr. Acrey and the child’s mother are currently involved in a civil dispute regarding custody of their son which appeared to serve as a motive for the false allegations.”

Initial allegations brought by the child’s mother were found to be false back in Jun 2023 by the Gordon County Department of Family and Children Services. Even after that, the mother made additional allegations in October 2023 used as the basis for the charges against Acrey, later found to be false.

The release noted that “the jurors also expressed their concerns about the manner in which the investigation was handled by the City of Rome Police Department.”

“Ultimately, justice has been served in this case,” McFall said in the release provided to Polk Today. “Josh Acrey left the Floyd County Courthouse on Wednesday, January 15, 2025 as a free man, unburdened from the allegations and charges that had haunted him since the first allegations were made in June of 2023. Josh looks forward to immediately reconnecting with his son, who he has not seen in ten months to repair the relationship that has been unjustifiably damaged due to the false allegations brought against him.”
